Child Support Issues

As in many other states, child support in Massachusetts is calculated according to a statute-set formula and guidelines. Whether the parents are married and divorcing, or were never together, there is an implicit obligation that both parents will contribute to the financial support of the child. These set guidelines help provide an enforceable law that is applied once paternity is established, if it was in question at any point in time.

Spousal Support In Massachusetts

When one spouse is requesting that the other pay spousal support, there are a variety of factors that are considered, including:

  • Age of the parties
  • Length of the marriage
  • Income contributions made by each party
  • Income-earning potential of each party
  • Health and well-being of each party

The courts may look at a variety of other factors and consider statements from each party as well. Unlike child support, there is no set way of calculating spousal support and as such, the court can be flexible in its decisions.
